Abstract
To indemnify a commercial agent, is a concept discussed with various titles within our legalsystem, even before the enactment of Turkish Commercial Code No.6102. This concept wastried to be applied within the framework of the regulations set forth before the CommercialCode No.6102, and had been a subject for discussions in doctrine and judgments of the Courtof Apply in this respect. With this study, while the principles of the regulation and its application,including the possible problems that may occur, is examined; a definition is tried to beproduced and the aim of this concept, regulated under the Code No. 6102, is tried to be explainedby taking the historical background in the Turkish Legal system into account.
Denkleştirme istemi, hukuk sistemimizde 6102 sayılı Türk Ticaret Kanunu'nun kabul edilmesindençok önce farklı başlıklar altında tartışılan bir kavramdır. 6102 sayılı Kanun'dan öncede mevcut düzenlemeler kapsamında, belirli bir ölçüde uygulamaya geçirilmeye çalışılmış, buçerçevede doktrinde ve Yargıtay uygulamasında farklı tartışmalara konu olmuştur. Bu çalış-mada 6102 sayılı Kanun'da yer verilen bu düzenlemenin, Türk Hukuk sistemindeki geçmişi degöz önüne alınmak suretiyle, amacı açıklanmaya ve denkleştirme istemi kavramına bir tanımgetirilmeye çalışılmıştır. Bu sırada hükmün içeriği ile uygulaması, uygulamada karşılaşılabilecekbir kısım sorunlarla birlikte, irdelenmiştir.
