Özet

Düşünceyi açıklama özgürlüğü, özgürlükçü bir demokratik düzen için kurucu öğedir. Çünküdüşünsel tartışmayı ve kendi varlık nedeni olan düşüncelerin savaşını olanaklı kılar. Düşünceninserbestçe oluşumu bir yandan "düşünceleri serbestçe açıklamak ve yaymak özgürlüğü-nü", diğer yandan açıklanan "düşüncelerden haberdar olmayı ve bilgi edinmeyi" şart koşar.Demokratik bir anayasal sistemde enformasyon özgürlüğü serbestçe kamusal düşünce oluşumununkoşulu olması nedeniyle, düşünceyi açıklama ve yayma özgürlüğünden daha aşağı birbasamağa yerleştirilmemelidir.Klasik temel haklarla korunan değerleri belki de aştığı için, internet özgürlüğünü kendineözgü, yeni bir temel hak olarak düşünmek ve düzenlemek gerekir. İnternet özgürlüğünde,internet vasıtasıyla telekomünikasyon özgürlüğü söz konusudur. Bu özgürlük, verileri, enformasyonlarıve düşünceleri yayarak iletmeği ve almayı kapsar.
Freedom of expression is the costituent element of a democracy since it brings in its trainintellectual debate and the contention of ideas, i.e. democracy's own raison d'etre. The freeformation of thought stipulates on the one hand "the free expression and dissemination ofideas" and on the other, "having access to and taking cognizance of ideas". Since in a democraticalconstitutional system freedom of information is the condition of the free formation ofpublic opinion, it should not be underestimated and considered below "the free expressionand dissemination of ideas".Free expression on the internet should be considered as a specific fundamental right andorganized accordingly since it is beyond the classical fundamental rights. Freedom of expressionon the internet means freedom of telecommunications through the medium of the internet.This freedom inheres in it the communication and reception of data, information and ideas.
