Bu çalışmada, aile hukuku ile borçlar hukukunun kesiştiği, kefalet sözleşmesi ile ilgili yeni bir madde olan "eşin rızası" başlıklı BK. m. 584'ün değerlendirmesi yapılacaktır. Ancak bu maddenin değerlendirmesine geçmeden önce, konunun daha iyi anlaşılmasına yardımcı olması için, evliliğin eşlerin hukuki işlem ehliyetine etkisi ile ilgili genel bilgi verilecektir.
In this study, article 584 of (Turkish) Code of Obligations, under the title of "spousal consent", which is a new provision on surety agreement that is at the cross section of family law and law of obligations, will be examined. However, before assessing this article, in order to give a better understanding of the issue, a general overview of the implications of the marriage on the legal capacity of spouses' will be provided.
